1. The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 386/2022, registered at Police Station City Kotwali, District- Bilaspur (CG) for the
2 offence punishable under Section 394, 506-II (4 counts), 323/34 (3 counts), 302/34 of IPC. 2. First Bail Application was dismissed as withdrawn by this Court vide its order dated 20.01.2025. 3. The prosecution story in brief, is that on 06.10.2022 at 00:15 pm, at Fokat Para, Shiv Chowk, Katiyapara, Bilaspur (C.G.) the present applicant along with co-accused Ravidas Manikpuri, Ankit Rajak and Manas threatened and assaulted the complainant Mangal Loniya, Pardeshneen Rajput, Sundariya Yadav with fists, lathi, plastice pipe and rod during the assault his father Prahlad Loniya intervened who succumbed to injury later on in hospital due to assault. 4. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 14.03.2023, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 5. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 6. I have heard learned counsel for the parties and perused the case diary. 7. Considering the facts & circumstances of the case, nature &
3 gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. Accordingly, the bail application of applicant- Santosh @ Tana Yadav involved in Crime No. 386/22 under Section 394, 506-II (4 counts), 323/34 (3 counts), 302/34 of IPC at Police Station- City Kotwali, District- Bilaspur, Chhattisgarh, is rejected. 8.
However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
