This Criminal Miscellaneous Petition has been filed invoking the jurisdiction of this Court under Section 528 of the B.N.S.S., 2023 with the prayer to quash the order dated 06.05.2025 passed by the learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj in connection with Hussainabad P.S. Case No.291 of 2023 registered for the offences punishable under Section 376/506 of the Indian Penal Code, Section 4/8 of POCSO Act and Section 66E/67 of the Information Technology Act whereby and whereunder the learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj has issued proclamation under Section 82 of the Code of Criminal Procedure consequent upon the petitioner absconding and concealing himself to evade his arrest. 3. Learned counsel for the petitioner submits that the allegation against the petitioner is false. It is next submitted that the impugned order ( 2025:JHHC:29761 ) 2 Cr. M.P. No.2812 of 2025 is not sustainable in law, hence, it is lastly submitted that the prayer as prayed for in this Cr.M.P., be allowed. 4. Learned Spl.P.P. appearing for the State vehemently opposes the prayer and submits that there is no illegality in the order dated 06.05.2025 passed by the learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj in connection with Hussainabad P.S. Case No.291 of 2023, hence, it is submitted that this Cr.M.P., being without any merit, be dismissed. 5. Having heard the rival submissions made at the Bar and after carefully going through the materials available in the record, it is pertinent to mention here that the learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj has recorded its satisfaction that the petitioner is absconding or concealing himself to evade his arrest and after thus recording its satisfaction ordered for issuance of proclamation under Section 82 of the Code of Criminal Procedure by fixing time 10:30 AM on 09.06.2025 for appearance of the petitioner before the said court, hence, this Court do not find any illegality in the impugned order dated 06.05.2025 passed by the learned Exclusive Special Judge, POCSO Act, Palamau at Daltonganj in connection with Hussainabad P.S. Case No.291 of 2023 warranting interference of this Court under Section 528 of the B.N.S.S., 2023. 6. Accordingly, this Cr.M.P., being without any merit is dismissed. (Anil Kumar Choudhary, J.)
