SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Lalit Yadav, Advocate. For the State : Mr. Shailesh Kr. Sinha, A.P.P. For the Informant : M/s Pratiush Lala and Deepak Sahu, Advocates.
…..... 06/07.05.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of the Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023, as the petitioner has been allegedly implicated in a criminal case registered under Section(s) 498A IPC and Sections 3/ 4 of the Dowry Prohibition Act, 1961, in connection with Meharma P.S. Case No. 33 of 2021 (G.R. No. 1020/2021), pending in the Court of learned Judicial Magistrate, 1st Class, Godda. Heard learned counsel for the parties at length and had gone through the documents, annexed along with this application. Opportunity was given to the informant as well as the State to oppose the bail, which they availed and opposed vehemently. There is allegation that the husband and the in-laws have tortured the wife. During course of argument, it has been submitted by the parties that the chargesheet has already been submitted and cognizance has already been taken, thereafter non-bailable warrant has been issued. Since the chargesheet has already been submitted, there is no scope of custodial interrogation. The submission of the chargesheet against this petitioner suggest that during the investigation it was not felt to take this petitioner in custody. Thus, the petitioner should appear before the Trial Court and file necessary bonds, which should be accepted. Accordingly, this application stands disposed of. Anu/-C.P.-3
