03/ 19.09.2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners are apprehending their arrest in connection with Barwadda P.S. Case No. 89 of 2025, registered for the offences under Sections 303(2), 317(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioners submits that petitioners are having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition. She submits that the name of the petitioners has come on the basis of confessional statement. She further submits that nothing incriminating has been recovered from the possession of the petitioners.

Learned A.P.P. appearing for the State has opposed the

prayer and submits that the name of the petitioners has come on the basis of confessional statement.

Considering that the petitioners are having no criminal antecedent and disclosure to that effect has been made in para-10 of the petition and nothing has been recovered from the possession of the petitioners and the name of the petitioners have come on the basis of confessional statement, I am inclined to provide the privilege of anticipatory bail to the petitioners.

Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Dhanbad, in connection with Barwadda P.S. Case No. 89 of 2025, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
