Mr. Imrul Hassan ORDER The case is taken up before the National Lok Adalat. The appellant, Oriental Insurance Company Limited, is represented by its duly authorized officials, namely, Mr. R. K. K. Sinha, Regional Manager, and R. C. Pathak, Manager. Mr. S. Roy, learned counsel, appears on behalf of the claimants and is present along with claimant No. 1, namely, Habija Begum. Page No.# 3/4 It is submitted that the total awarded amount is Rs. 27,28,000/- (Rupees twenty seven lakhs twenty eight thousand) only. After negotiation, both the parties have mutually agreed to settle the matter for a sum of Rs. 20,00,000/- (Rupees twenty lakhs) only, out of which Rs. 13,64,000/- (Rupees thirteen lakhs sixty four thousand) only has already been paid and a balance amount of Rs. 6,36,000/- (Rupees six lakhs thirty six thousand) only is agreed upon as a full and final settlement of the claim. Accordingly, the appellant/Oriental Insurance Company Ltd. is hereby directed to deposit the amount of Rs. 6,36,000/- (Rupees six lakhs thirty six thousand) only before the Registry of this Court within 1 (one) month from the date of the order. The claimant No. 1, namely, Habija Begum, shall be entitled to receive Rs. 3,81,600/- (Rupees three lakhs eighty one thousand six hundred) only and the claimant No. 2, namely, Husna Begum @ Husnara Begum, shall be entitled to receive a sum of Rs. 2,54,400/- (Rupees two lakhs fifty four thousand four hundred) only. Accordingly, the claimant No. 1, namely, Habija Begum, and the claimant No. 2, namely, Husna Begum @ Husnara Begum, are permitted to withdraw their respective shares of the amount, which will be deposited by the Insurance Company before the Registry of this Court, upon proper verification and identification. Page No.# 4/4 Registry to refund the statutory deposit of Rs. 25,000/- (Rupees twenty five thousand) only to the appellant/Insurance Company. The appeal stands disposed of in terms above.
