Heard learned counsel Mr. A. Sarma as well as learned counsel Mr. W. A. Rahman for the petitioner, Pomki Daimari @ Pankhiraj Daimari, who has filed this application under Section 482 of the BNSS, 2023 with prayer for pre-arrest bail as he is apprehending arrest in connection with Udalguri P.S. Case No. 55/2025 registered under Section 103 (1)3(5) of BNS, 2023.
2. Heard Ms. N. Das, learned Additional Public Prosecutor for the respondent State.
3. The allegation against the petitioner is that he is involved in the assault, which resulted in the death of the 19 year old victim, Priyagan Daimari. It is submitted that the petitioner had no intent to commit the murder of the victim. It is submitted that now that charge-sheet has been submitted, the petitioner is willing to cooperate with the trial.
4. The learned Additional Public Prosecutor has raised serious objection stating that the petitioner did not cooperate with the investigation, which resulted in the charge-sheet showing him as an absconder. It is further submitted that several dates were fixed for the appearance of the petitioner and warrants have already been issued against him, but even then the petitioner failed to appear. It appears that the petitioner's submission that he will cooperate with the investigation appears to be bleak.
5. I have considered the submissions at the bar with circumspection. I have
Page No.# 3/3 also considered the scanned copies of the Trial Court Record and I have scrutinized the same. I have considered the gravity of the offence under which the petitioner is booked.
6. Considering the submissions at the Bar and considering all aspects, this court is hesitant to grant anticipatory bail to the petitioner at this stage. Hence, petition stands rejected.
