By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Dharmeswar Roy, has prayed for granting pre-arrest bail, apprehending arrest in connection with Bhangagarh P.S. Case No. 173/2024 (corresponding to G.R. No. 6847/2024) under Section 318(4) of BNS, 2023. 3. The gist of the case as have been narrated in the FIR lodged by one Gopal Chetri before the Officer-in-Charge of Bhangagarh Police Station on 08.11.2024 are that the accused applicant had fraudulently cheated him of Rs.1,02,500/- on the pretext of buying a motorbike from him. It is alleged that the accused applicant fraudulently obtained the OTP from him for withdrawing the money and thereafter, selling the vehicle to Hero Show room at ABC, disappeared from the scene. It is alleged that he fraudulently misrepresented as the owner of the Motorbike and sold the motorbike to the aforesaid Hero Show Room at ABC. 4. On projected health grounds, the petitioner was granted interim bail on 14.10.2025 with some conditions and the same was however, extended vide order dated 08.12.2025. 5. The case diary was called for but in this context the learned Additional Public Prosecutor submits that investigation is complete in this case resulting in a charge sheet and the present petitioner was sent up for trial. 6. In view of the completion of investigation in the instant police case, I am not inclined to cancel the interim bail granted earlier.
Accordingly, the
Page No.# 3/3 interim protection vide dated 14.10.2025 is hereby made absolute subject to the conditions – (i) available for trial and shall appear before the trial court on the concerned dates (ii) shall not hamper and tamper with evidence (iii) shall not misuse the liberty to commit any offence(S). 7. Violation or breach of condition(s) shall entail cancellation of the bail. 8. The petition stands disposed of accordingly. 9. Send back the case diary. JUDGE Comparing Assistant
