2. Petitioner has been made accused in connection with Lohsinghna P.S. Case No. 79 of 2024 for the offences registered under sections 376 and 366-A of the Indian Penal Code and section 4, 6 and 8 of POCSO Act, pending in the court of learned Additional Sessions Judge-III-cum- Special Judge, POCSO Act, Hazaribagh.
3. Petitioner is alleged to have enticed away 15 years minor daughter of the Informant. She was taken to Delhi where petitioner is alleged to have established physical relationship with her.
4. Mr. A.K. Sahani, learned counsel appearing on behalf of the petitioner submitted that the parties were having affairs and the victim has herself left her lawful guardianship.
5. Age of the victim has also been assessed as 14 years. Consent of the victim for physical relationship is immaterial.
6. In view of the aforesaid facts, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail stands rejected.
