1. Heard Mr. T Laskar, learned counsel for the petitioner. Also heard Ms. N Das, learned Additional Public Prosecutor for the State of Assam. Page No.# 2/3
2. By this application under Section 482 of the BNSS, 2023 the petitioner has sought for pre-arrest bail in connection with Hojai P.S Case No 274/2025 registered under Section 303(2)/325/196/299 of the BNS, 2023 R/W Section 13/05 of Assam Cattle Preservation Act,
2021. 3. The FIR dated 07.09.2025 reveals that on an information that one person was apprehended by local people on the allegation of having stolen cattle and slaughtered the same at a particular place, the police arrived at the place of occurrence and in the courtyard of the petitioner, suspected beef meat was found and upon weighing the same, it was found to be 54 kg. It is also stated in the said FIR that during the enquiry, witnesses stated that on the night of 06.09.2025, their cow was stolen by the petitioner and thereafter, it was slaughtered in the courtyard of the petitioner. 4. Mr. T Laskar, learned counsel for the petitioner submits that there is nothing in the FIR which could lead to a conclusion that it was the stolen cow which was slaughtered and that too whether the same was slaughtered in the courtyard of the petitioner. He further submits that the amount of meat found also does not tally with a full grown cow. 5. Ms. N Das, learned Additional Public Prosecutor for the State of Assam submits that the co-accused had stated that he, along with the petitioner stole the cow from a neighbor and slaughtered the same in the courtyard of the petitioner. 6. In view of what has been stated above, this Court does not deem
