This is an application under Section 482 of the BNSS, 2023 praying Page No.# 2/2 for grant of pre-arrest bail to the accused/petitioner, viz., Sameer Ali in connection with Basistha P.S. Case No.472/2025 registered under Sections 109/115(2)/117(2)/189(2) of the BNS, 2023. It appears that the accused/petitioner was granted interim pre- arrest bail by this Court on 26.09.2025 and the Case Diary was called for. The Case Diary as called for has been received. I have perused the same. The learned Addl. P.P. with reference to the materials available in the Case Diary submits that there is sufficient incriminating materials against the petitioner including the eye-witnesses account regarding the involvement of the petitioner in the instant case. Considering the above, it is not a fit case for grant of pre-arrest bail. Consequently, the prayer for pre-arrest bail stands rejected. The order of interim pre-arrest bail dated 26.09.2025 hereby stands vacated. Return the Case Diary. The Anticipatory Bail Application stands disposed of. JUDGE Comparing Assistant
