...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, order, orders or directions more particularly one in the nature of Writ of Mandamus to declare the proposed action of Respondents 3 and 5 and their privies touching upon the property of subject temple lying in an extent of about Ac.00.05 Cents and odd under R.S.No.230 of Tatipaka village under the pretext of proposed beautification at Junction of Tatipaka, despite binding precedent of Division bench dated.12.02.l998 in W.P.No.27484 of 1997 on the file of this Hon'ble Court, apart without following the due process of Law as illegal, arbitrary, biased, unconstitutional and against the principles of natural justice and sheer violation under Arts.14, 21, 25, 26 and 300-A of Constitution of India.
IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents not to meddle with the subject temple and land appurtenant there to situated in R.S.No.230 of Tatipaka village of Razole Mandal, Dr.B.R.Ambedkar Konaseema (Ertswhile Eastgodavari) District, pending disposal of the above Writ Petition and to pass Counsel for the Petitioner:

The hereditary trustee of Sree Ramachandra Murthy Devasthanam filed the above writ petition, complaining of the highhanded action of respondents 3 & 5 in trying to interfere with the subject temple situated in Ac.0.05 cents in Sy.No.230 of Tatipaka Village, Razole Mandal, Dr.B.R. Ambedkar, Konaseema (Erstwhile Eastgodavari) District, under the pretext of beautification at the Junction, without issuing any notice, as illegal and arbitrary. 2. Heard Sri D.V.V.S.S.N.H. Bhujanga Rao, learned counsel for the petitioner and Sri B.V. Satyanarayana, learned Assistant Government Pleader for Revenue, appeared for respondents 1, 3, 5 & 9 and Sri Ch.Praveen, learned Assistant Government Pleader for Roads & Buildings, appeared for respondents 2, 4, 6, 7 & 8. 3. Learned counsel for the petitioner would submit that despite the direction of the Division Bench in W.P.No.27484 of 1997, respondents 3 & 4 are interfering with the subject temple. 4. Sri B.V. Satyanarayana, learned Assistant Government Pleader for Revenue, on instructions, would submit that respondents 3 & 5 are not interfering with the subject temple. The same is recorded. 5. Given the facts and circumstances of the case, without touching the merits of the matter, the Writ Petition is disposed of at the stage of admission with the consent of both the learned counsel, directing the respondents 3 & 5

not to interfere with Sree Ramachandra Murthy Devasthanam situated in an extent of Ac.0.05 cents in Sy.No.230 of Tatipaka Village, Razole Mandal, Dr.B.R. Ambedkar, Konaseema (Erstwhile Eastgodavari) District, without following due process of law. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
