THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI SECOND APPEAL No.458 OF 2003 J U D G M E N T:
No representation for the appellant, inspite of listing the matter under the caption “for dismissal”. It appears that for the last two adjournments, the learned counsel for appellant sought time for getting instructions and did not come forward to prosecute the appeal. It shows that the appellant failed to prosecute the appeal.
2. In that view of the matter, the Second Appeal is dismissed for non-prosecution. There shall be no order as to costs.
As a sequel, interlocutory applications pending, if any, shall stand closed.
