The instant Writ Petition is filed by the Petitioner seeking indulgence of this Court under Article 226 of the Constitution of India for the following relief:

“ .... to issue a Writ order or order more particularly in the form of Writ of Mandamus by declaring the inaction of Respondent No.2 and 3 in registering the offense as per my complaint dated 01/07/2024 submitted to Respondent No.2 as illegal and arbitrary and a violation of the order of the Hon'ble Supreme Court in Appeal (CrI.) No.5883/2020 dated 08/08/2023 and consequently, direct respondents Nos.2 and 3 to register the offense as per my complaint dated 01/07/2024 submitted to respondent No.2 and pass ....”
Heard learned counsel for the Petitioner and learned Assistant Government Pleader for Home appearing for respondent State. Perused the material on record.
Learned counsel for the Petitioner would submit that Petitioner filed a complaint against some persons, who committed cheating, forgery by fabricating a fake sale deed. Further, petitioner gave a complaint against the said persons, but the Police did not register the case against them so far.
Learned Assistant Government Pleader for Home, on instructions, would submit that the matter is purely civil in nature and that the complaint is not registered by the Police and that this Writ Petition may be disposed of by passing appropriate orders.
In that view, this Writ Petition is disposed of. Petitioner is at liberty to work out his remedy before appropriate forum according to law. No order as to costs.
Pending applications, if any, shall stand closed.
