Neutral Citation No. - 2025:AHC:25966 Court No. - 5 Case :- WRIT - A No. - 7769 of 2020 Petitioner :- Smt. Vasundhara Devi Respondent :- State Of U.P. And 4 Others Counsel for Petitioner :- Vidya Bhushan Srivastava,Vikas Tiwari Counsel for Respondent :- C.S.C.,Kunwar Bahadur Srivastava,Vimal Chandra Chaudhary Hon'ble Ajay Bhanot,J. Heard Shri Vikas Tiwari, learned counsel for the petitioner, Shri Ravindra Singh, learned counsel holding brief of Sri Vimal Chandra Chaudhary, learned counsel for the respondent no. 5 and learned Standing Counsel for the State. The petitioner claims entitlement to various retiral benefits and arrears of salary of 6th Pay Commission from the year
2006. He has made a representation in this regard but to no avail. The only prayer made on behalf of the petitioner is that her representation may be decided within a stipulated period of time. Sri Vimal Chandra Chaudhary, learned counsel for the respondent no. 5 submits that the matter requires determination of facts by the competent authority as per law in the first instance. However, he fairly contends that service benefits/claim is liable to be decided by the
competent authority in a reasonable time frame. In light of the aforesaid submissions and without going into the merits of the case, the the respondent no. 5 is
directed to decide the representation of the petitioner for disbursal of various retiral benefits and arrears of salary of 6th Pay Commission from the year 2006 as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation. The petitioner shall not be entitled to interest on account of the delay on his part to make the claim. With the aforesaid direction, the writ petition is finally
disposed of.
