It is submitted that the petitioner has completed the work and also submitted the final bills and that the progress of work was also entered in the M-Book. The respondent authorities also finalized the payments and also f released all the security deposit. It is submitted that an amount of Rs.2,62,39,206/- is due towards the running account bills and also towards release of the security deposit. It is also submitted that the Deputy Executive Engineer has certified the work done and also recorded in the M-book. Aggrieved by the non-payment of bills for the works executed, the present writ petition is filed. On written instructions, the learned Standing Counsel appearing for 3. respondent No.3, submits that the petitioner did not complete the work and without completing the work the petitioner has been repeatedly requesting for release of payments which cannot be entertained. It is also submitted that the respondent authority is willing to pay the bills for the finished item of work and not for the unfinished item for the work. Heard the learned counsel for petitioner and the learned Standing 4. Counsel for respondent No.3. 5. There shall be a direction to respondent No.3 to release the payments for the works executed by the petitioner as was certified by the competent authority in the M-Book within a period of eight (8) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
