Heard Mr. B. Choudhury, learned counsel for the petitioner. Also heard Mr. R.J. Baruah, learned Addl. P.P. appearing for the State respondent.
2. This application under Section 483 of BNSS, 2023 has been filed by the accused petitioner, namely, Rahul Badcha, praying for grant of bail in connection with Kayan P.S. Case No. 51/2024 corresponding to G.R. Case No.949/2024 under Sections 87/115(2)/127(2)/351(2) of BNS, 2023, R/W Section 9/11 of Prohibition of Child Marriage Act arises out of FIR lodged by one Saful Ali on 19.12.2024. The petitioner was arrested on 19.10.2025.
3. The learned counsel submits that the alleged victim girl, who was allegedly subject to a child marriage, has been recovered. The alleged victim was handed over to the informant.
4. The learned Addl. P.P. submits that in the meantime upon completion of investigation, the case has been charge- sheeted vide C.S. No. 23/2025 dated
30.10.2025. The learned Addl. P.P. objects to grant of bail at this stage.
5. Considering the completion of investigation and length of detention - the accused person is hereby allowed to go on bail of Rs. 30,000/- with one surety of like amount to the satisfaction of the learned concerned Court and subject to the following conditions that:- (i) That the accused person shall be available for trial, if one commences,
Page No.# 3/3 (ii) That the accused person shall not hamper or tamper with evidence. (iii) he shall not commit any illegal activities,
6. Violation of any bail conditions will entail cancellation of the bail.
7. This bail application stands allowed and disposed of.
