For Respondent(s) For Complainant : : : Mr. Shree Ram Dhakar, PP Mr. Manan Mathur, Adv. Mr. Dishant Karnawat, Adv. HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 11/08/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.331/2024, registered at Police Station Civil Lines, District Ajmer, for the offence(s) under Sections 420, 467, 468, 471 and 120-B of IPC. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in this case. It is contended that the disputed property was sold by Hasan Abbas to the complainant and the petitioner was not the party to the contract. It is contended that the co-accused Abbas has not made any allegations against the petitioner. It is further contended that the alleged agreement was executed in favour of co-accused Abbas [2025:RJ-JP:30994] (2 of 3) [CRLMB-9627/2025] without any knowledge of the petitioner. It is contended that Abbas and Ajay Choudhary fraudulently created the documents in his name and the petitioner was not aware about the same. It is further contended that even if it is presumed that the petitioner has created the documents then also there is no privity of contract between the petitioner and the complainant. The accused- petitioner is in custody since 19.04.2025, charge-sheet has already been produced, trial of the case may take considerable time and the matter is exclusively triable by Magistrate, therefore, the bail application of the accused-petitioner may be allowed. 3. Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail application. It is contended that the petitioner sold the property to Hasan Abbas and thereafter the said property was sold to the complainant. The petitioner despite not being the owner of the property sold it to Hasan Abbas and the said property was thereafter sold to the complainant, therefore, considering the above facts, the bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. The charge-sheet against the petitioner has already been produced and the alleged agreement was executed between the complainant and the other co-accused Hasan Abbas, therefore, considering the above facts, this Court deems it proper to enlarge the accused-petitioner on bail. 6. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused petitioner- [2025:RJ-JP:30994] (3 of 3) [CRLMB-9627/2025] Anil George S/o Sesil George, in connection with FIR No.331/2024, registered at Police Station Civil Lines, District Ajmer, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
