The instant writ petition has been instituted with a prayer for consideration of the representation for remission. Page No.# 3/4 3. As per the facts projected, an NIT was issued on 23.10.2019 which was preceded by a litigation culminating in an order dated 08.08.2019 passed in WP(C)/5620/2019. In the said tender process, the petitioner had emerged as the highest bidder and was settled with the Pakaria beel in the district of Morigaon vide an order dated 18.12.2019. After completion of 4 years of the settlement period, another order was passed on 23.07.2024 extending the settlement for a further period of 3 years up to 31.03.2027. The petitioner alleges that there was massive erosion in the Brahmaputra River which adversely affected the fishing activities and accordingly application for remission has been made. 4. After issuance of notice, the AFDC represented by Shri Sharma, the learned Standing Counsel, AFDC has filed an affidavit-in-opposition on 03.12.2025. In the said affidavit, it has been stated that the representation of the petitioner is under consideration. For ready reference, the relevant averments made by the respondent nos. 1, 2, 3, 6 & 7 in the affidavit-in- opposition is extracted herein below: “4. That the deponent begs to state that the grievances of the petitioner in the instant writ petition regarding the adjustment of the revenue in pursuance of the communications from the district administration regarding siltation of the part of the settled fishery has been considered by the Board of Directors and the same is under process.” 5. A similar stand has also been taken by the respondent no. 4 in its affidavit filed on 12.11.2025 which reads as follows: “5. That with regard to the statement made in paragraph No. 5 of the writ petition, the answering Respondent begs to state that as per the letter received from the Managing Director, Assam Fisheries Development Corporation Ltd. it was reported that 82B, OK, 08L area of land of Pakaria river was affected by erosion and some of a portion of the river was filled with sediment. The affected dags are 38 (Village Kashsila), 411 (Village- Page No.# 4/4 Hatimuria), 35 Part (Village 1 No. Murkata), 162 parts (Teteliguri).” 6. In view of the aforesaid stand of the respondents, this Court is of the opinion that there may not be any further requirement of continuing this writ petition. 7. The petition is accordingly disposed of with a direction to the respondent authorities to consider the case of the petitioner by passing a Speaking Order expeditiously and preferably within a further period of 2 (two) months from the date of the receipt of a certified copy of this order which is required to be communicated to the petitioner.
