1. This third anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicant, who is apprehending his arrest in connection with Crime No. 595 of 2024 registered at Police Station –Kotwali Ambikapur, District- Surguja (C.G.)
2 for the offences punishable under Sections 318(4), 336(3), 338, 340(2) of BNS, 2023.

This Court vide order dated 20.12.2024, in MCRC No. 1473 of 2024, the first bail application has been dismissed on merits thereafter, the applicant had moved his second bail application and vide order dated 06.03.2025 in MCRC No. 319 of 2025, it has also been dismissed. Hence, the third bail application.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in this case. He submits that the applicant is an old aged person and suffering from various health problems that requires constant care and treatment. He further submits that the other co-accused person namely Ashok Agrawal has already been enlarged on bail on medical ground vide order dated 30.01.2025 passed in M.Cr.C. (A) No. 137 of 2025. Hence, he prays that the applicant be also extended benefit of anticipatory bail on the ground of parity.
4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the bail application.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the submissions made by the learned counsel for the parties particularly considering the fact that the earlier two bail applications have already been dismissed and also considering the fact that allegation made against the applicant appears to be of serious in nature, which needs to be investigated thoroughly / properly and also
3 considering the fact that there is no change in circumstances to entertain this third anticipatory bail.
7. Accordingly, the third anticipatory bail of the applicant – Ghanshyam Agrawal involved in Crime No. 595 of 2024 registered at Police Station – Kotwali Ambikapur, District- Surguja (C.G.) for the offences punishable under Sections 318(4), 336(3), 338, 340(2) of BNS, 2023. is rejected. Sd/-
