For Respondent(s) : Mr. Shree Ram Dhakar, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 11/03/2025 1. Apprehending his arrest in connection with FIR No.128/2024, registered at Police Station Mundawar, District Kherthal-Tijara, for the offence(s) under Sections 323, 341, 452, 427 and 34 of IPC, the accused-petitioner has preferred this criminal misc. bail application under Section 482 of B.N.S.S. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the petitioner appeared before the concerned Investigating Officer in pursuant to direction given by this Court vide order dated 30.08.2024, custodial interrogation of the petitioner is not required, all the offences alleged against the petitioner are triable by Magistrate, there are no criminal antecedents against the petitioner and the petitioner is ready and willing to co-operate with the investigation, therefore, the anticipatory bail application of the accused-petitioner may be allowed. [2025:RJ-JP:11310] (2 of 2) [CRLMB-9224/2024] 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application and submitted the factual report, the same is taken on record. 4. Heard and perused the material available on the record. 5. Considering the fact that the alleged offences are exclusively triable by Magistrate, custodial interrogation of the petitioner is not required, the petitioner is ready and willing to co-operate with the investigation and there are no criminal antecedents against the accused-petitioner, without commenting anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner. 6.
