It has been stated that certified copy of the judgment passed by learned Court below was received by the counsel but same was misplaced in his office, therefore, in such circumstances delay has occurred in filing the present appeal. In para No. 3 of the application the reason has been assigned for the said delay, which is plausible. In view of the submissions made by learned counsel for the parties, and since the averments in the application are duly supported by an affidavit, the present application is allowed and delay of 72 days in filing RSA is condoned.
