THE TAHSILDAR, MYLAVARAM MANDAL, Y.S.R DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondent No.4 in interfering with the rights of the petitioner over the land in an extent of Ac.1.16 cents in Sy.No.617 and Ac.0.82 cents in Sy.No.618 of Thorrivemula Village, Mylavaram Mandal, Y.S.R Kadapa District, without adhering to due process of law, that too without putting him on notice as arbitrary, illegal, 2 colorable exercise of power and contrary to the well established legal principles apart from being violative of the fundamental and the Constitutional rights guaranteed to him under Articles 14, 19, 21 and 300-A of the Constitution of India and consequently direct the respondent No.4 not to interfere with the rights of the petitioner over the land in an extent of Ac.1.16 cents in Sy.No.617 and Ac.0.82 cents in Sy.No.618 of Thorrivemula Village, Mylavaram Mandal, Y.S.R Kadapa District and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased direct the respondent No.4 not to interfere with the rights of the petitioner over the land in an extent of Ac. 1.16 cents in Sy.No.617 and Ac.0.82 cents in Sy.No.618 of Thorrivemula Village, Mylavaram Mandal, Y.S.R Kadapa District, without adhering to due process of law, pending disposal of the above Writ Petition and pass Counsel for the Petitioner: 1. The Court made the following ORDER: Heard Sri N.Roopeswara Reddy, learned counsel representing Sri V.R.Reddy Kovvuri, learned counsel for the petitioner and Sri Ramesh, learned Assistant Government Pleader for Revenue for respondents 1 to 4. 2. The grievance of the petitioner is that the 4th respondent-Tahsildar is interfering with the petitioner’s possession over the land in an extent of Ac.1.16 cents in Sy.No.617 and Ac.0.82 cents in Sy.No.618 of Thorrivemula Village, Mylavaram Mandal, YSR Kadapa District, without issuing any notice. 3. Learned counsel for the petitioner would submit that the petitioner is the absolute owner of the aforementioned landed properties. The petitioner got the same by way of inheritance, and the name of the petitioner is updated in the Record of Rights. The 4th respondent issued a Pattadar Pass Book 3 (Ex.P.1) and RoR-1B and Adangal (Ex.P.2). Learned counsel further submits that the 4th respondent, without issuing any notice, is interfering with the petitioner’s possession over the aforementioned landed properties. 4. Learned Assistant Government Pleader on oral instructions would submit that the 4th respondent is not interfering with the petitioner’s possession over the aforementioned properties. The submission of learned AGP is recorded. 5. Given the facts and circumstances of the case, the Writ Petition is disposed of at the admission stage with the consent of learned counsel on either side directing the 4th respondent not to interfere with the petitioners possession over the land in an extent of Ac.1.16 cents in Sy.No.617 and Ac.0.82 cents in Sy.No.618 of Thorrivemula Village, Mylavaram Mandal, YSR Kadapa District, without following due process. No order as to costs.
