Ajay Mohan Goel, Judge (Oral) When this case was taken up for consideration, learned Additional Advocate General has drawn the attention of the Court to Annexure P-13, appended with the petition, which is an order passed by the Hon’ble Division Bench of this Court in a CWPIL filed by the present petitioner, which reads as under:- “Counsel for the petitioner submits that he has instructions to withdraw the present petition with liberty to 1Whether reporters of the local papers may be allowed to see the judgment? 2 2025:HHC:32261 file afresh after giving material particulars. 2. In view of the above, the present petition is dismissed as withdrawn with liberty as prayed for. 3. All pending applications are disposed of accordingly.” 2. On a query put to the learned counsel for the petitioner, he fairly stated that the said writ was pertaining to the same cause of action and the petition was withdrawn with liberty to give material particulars. 3. I have perused the averments made in this petition and obviously, as the cause pleaded therein is the same as was in CWPIL No. 29 of 2025, the petitioner has to approach this Court by way of a Public Interest Litigation. 4. Accordingly, this petition is permitted to be withdrawn, with liberty to the petitioner to prefer a petition on the format of Public Interest Litigation.
