Singh, Advocate For the State : Mr. Bishwambhar Shastri, APP ----- 04/07.05.2025: This is an application filed by the petitioner praying for grant of anticipatory bail in terms of sections 482 and 484 of the Bharatiya Nagarik Suraksha Sanhita, 2023, as the petitioner has been allegedly implicated in connection with Sector 12 PS Case No. 16 of 2024, registered for the offences punishable under section 147, 148, 149, 323, 324, 307, 504 and 506 of IPC, pending in the court of learned J.M. 1st Class, Bokaro. 2. Heard the learned counsel for the petitioner and the learned counsel appearing on behalf of the State. 3. In this case it is alleged that during immersion procession of Sarswati Puja there was fight between two groups in which informant was assaulted with a sword. 4. The learned counsel appearing on behalf of the State after going through the case diary admits that the allegation of assault is not upon this petitioner rather it is on someone else. 5. From the impugned order I find that the learned trial court has also observed that all the sections except section 307 of the Indian Penal Code are bailable in nature. Since there is nothing on record that this petitioner has assaulted the injured, my opinion is that section 307 IPC is not applicable against this petitioner, at this stage. So far as other offences are concerned, all are bailable in nature. Thus, the petitioner should surrender before the learned court below and file appropriate application. 6.
