The Court made the following Order:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents in contemplating to grant house site pattas to various beneficiaries on public passage/ road admeasuring to an extent of Ac.1.80 cents covered by Sy.No.38 situated at Yedavalli Village of Lingapalem Mandal, West Godavari District under flagship programme ‘Navaratnalu-Pedalandariki Illu’ sponsored by the 1st respondent, thereby blocking access to the agriculture land of the petitioner and also to the adjoining land owners. 3. On the other hand, the learned Assistant Government Pleader relying upon the counter of the 4th respondent submits that the excess road margin was arranged for the house site pattas and the earlier encroachers on the subject cart track were removed. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land strictly in accordance with law, if so required for any public purpose, if not already availed for the above said purpose. 5. Accordingly, the writ petition is disposed of. Interim order if any, deemed to have been vacated. There shall be no order as to costs. 4
