Learned counsel for the petitioners submits that the petitioners are in custody for more than 4 months, more than 5 months and more than 3 months respectively. Charge sheet has been submitted. One of the co-accused has been granted bail by the learned Sessions Court. Further detention of the petitioner is not required. Learned counsels for the State and defacto complainant oppose the prayer. I have considered the material on record. Eye witnesses to the incident have implicated the petitioners. One of the injured has succumbed to his injuries. Co- 2 accused on bail does not appear to be on the same footing as the petitioners. Considering the gravity of the offence and prima facie involvement of the petitioners therein, prayer for bail is rejected at this stage. The application for bail is disposed of.
