Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 19.12.2025 [1] Heard Mr. Juno Rahman, learned counsel for the petitioner. [2] The petitioner who is the recorded pattadar for a piece of residential plot bearing Patta No. 28/521/764 (old)/711 (new) covered by D.S. Dag No. 2077 measuring an area of 0.0580 hectare situated at Village NO. 28-Thoubal Achouba, Thoubal approached this Court being aggrieved by the impugned notice dated 24.11.2025 issued by the Caretake Chairperson, Thoubal Municipal Council, Thoubal for meeting to be held on 03.12.2025. The petitioner is particularly aggrieved by an agenda No. 16 i.e. representation/objection to the construction of public toilet at eastern side of Thoubal Market. [3] It is the case of the petitioner that at the initiation of the Thoubal Municipal Council, the demarcation proceeding was conducted by the office of the Assistant Survey and Settlement Officer, Thoubal and notice was issued to the petitioner herein and others. The petitioner being not satisfied with the measurement, the petitioner and others filed objection and in spite of filing objection, the decision has been taken in the demarcation case. [4] The petitioner has submitted a representation dated 21.11.2025 to the Deputy Commissioner, Thoubal District, Manipur raising objection to the proposed construction of public toilet as the same has encroached upon the patta land of the petitioner. It is also stated that a decision has already been taken by the Thoubal Municipal Council for construction of the same without considering his objection. However, the petitioner could not get a copy of the decision of the Thoubal Municipal Council. [5] In the circumstances, it is prayed that the writ petition may be disposed of by directing the respondents to consider the representation/ objection dated 21.11.2025 submitted by the petitioner to the DC, Thoubal before taking the final decision of construction in the proposed toilet and other similar objections before taking a final decision of constructing the proposed toilet complex in Thoubal Market Complex. [6] With this observation, writ petition is disposed of. Misc. application is disposed of. [7] This Court does not express any opinion on the merit of the case.
