JUSTICE PRAVEER BHATNAGAR
Order 26/08/2025
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 59/2022 registered at Police Station Gangdhar, District Jhalawar for the offences under Sections 420, 467, 468, 471 and 120-B of IPC.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. He further submits that other co-accused Kesar Singh, Shivlal, Shankar Singh, Pur Singh and Bhagwan Singh have already been enlarged on bail by the co-ordinate Bench. The case of the petitioner is on better footing then the case of other co-accused who have been enlarged on bail. The petitioner has been implicated in the alleged offense solely on the basis of disclosure statement of other co-accused. There is no substantive evidence available on record indicating the fact that the petitioner forged
[2025:RJ-JP:33954] (2 of 2) [CRLMB-9505/2025] the documents or caused any wrongful loss to the complainant and wrongful gain to himself. The charge-sheet has already been submitted against the accused-petitioner before the concerned Court. The accused-petitioner is in custody since 05.07.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application.
4. Heard and perused the material available on record.
5. Considering the arguments advanced by learned counsel for the petitioner and looking to the fact that the similarly placed co- accused have already been enlarged on bail by the Co-ordinate Bench. The accused-petitioner is in custody since 05.07.2025 and trial of the case may take considerable time. The offences alleged against the petitioner are triable by Magistrate and there are no criminal antecedents against the accused-petitioner, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Preetam Singh @ Pari Singh S/o Ude Singh @ Udai Singh, in connection with FIR No. 59/2022 registered at Police Station Gangdhar, District Jhalawar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
