Mr. Naresh Kaul, Advocate, for the applicant. The present application has been filed by the respondent/applicant for release of the awarded amount in his favour which is admittedly challenged by the non objectors in the Arbitration Appeal, which is still pending. It is contended by the learned Advocate General that he shall be opposing the release of any amount, however, he submits that in order to maintain the balance between the parties, 50% of awarded amount can be released to the respondent subject to furnishing of the Bank guarantee by the present respondent to the effect that in case the judgment in the appeal goes against him, in that event he shall refund the entire awarded amount alongwith up-to- date interest to the State without any protest. Consequently, it is ordered that 50% of the total awarded amount be released in favour of respondent in his Saving Bank Account No. 13210210000885 subject to the applicant furnishing Bank guarantee to the satisfaction of Registrar (Judicial) within a period of four weeks from today.
