By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, After Hussain @ Jakir Ali, has prayed for granting pre-arrest bail, apprehending arrest in connection with Sivasagar P.S. Case No. 135/2025 under Section 13(1) of Assam Cattle Preservation Act. 3. The case arose out of an FIR dated 04.09.2025 lodged by 12 members of the public with allegation that under the leadership of Jakir Ali, they are noticing illegal transport of cattle including slaughter and selling cow meat in the area. It is also alleged that due to such activity, social environment has been damaged. 4. The learned counsel for the petitioner submits that the petitioner is not involved in the alleged offence. 5. The learned Additional Public Prosecutor submits that case diary has been received and investigation is in progress but the chemical report regarding nature of meat is awaited. 6. In the given facts and circumstances and considering the progress of investigation, granting anticipatory bail to the petitioner may not prejudice the investigation. 7. Accordingly, it is provided that in the event of arrest of the petitioner, named above, in connection with Sivasagar P.S. Case No. 135/2025 under Section 13(1) of Assam Cattle Preservation Act, he shall be released on furnishing bail bond of Rs.30,000/- with a suitable surety of the like amount, to the satisfaction of the arresting authority. 8. The direction for pre-arrest bail is subject to the condition that the petitioner: Page No.# 3/3 (a) shall render cooperation with the remaining investigation; (b) shall not hamper or tamper with evidence; (c) shall not try to influence any witnesses; (d) shall be available for trial, if one commences; and (e) shall not indulge in any illegal activity prohibited under the Assam Cattle Preservation Act. 9. Violation of condition(s) shall entail cancellation of pre-arrest bail. 10. The anticipatory bail application stands allowed and disposed of. 11. Send back the case diary. JUDGE Comparing Assistant
