1. Heard Mr. M. Handique, learned counsel appearing for the accused petitioner as well as Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the State respondent. Page No.# 2/3
2. This petition under Section 483 of the BNSS, 2023 has been filed by the accused-petitioner, namely, Binud Borah, praying for grant of bail in connection with Helem P.S. Case No.74/2025 under Sections 118(1)/109(1)/121(1)/351(3)/296/132/126(2) of BNS, 2023. 3. Case diary as called for is received. 4. The gist of the allegations is that on an information, the present accused after being intoxicating was creating public nuisance and therefore, upon information GD entry number 12 was made and thereafter, the informant along with SI, Ranjan Saikia and other staff reached a spot and found plastic containers containing 18 liters of suspected Sulai in the courtyard of the accused for illegal sell and when his father alleged that while enquiry was being conducted regarding the same, the accused emerged with a dao in his hands and assaulted Ranjan Saikia. 5. The learned counsel for the petitioner submits that the allegations in the FIR are concocted and false. It is submitted that the real story is that the police personnel entered his house and went to the bedroom where his wife and minor child were sleeping and he asked them as to why he had come accompanied by woman police person. 6. The case diary has been received. 7. It is submitted by learned Additional Public Prosecutor that the investigation reveal some adverse materials against the petitioner. 8. However, considering the length of detention and progress in investigation and also keeping in mind the projected deficiencies in the notice under Section 36 BNSS - I deem it fit to grant bail to the accused. 9.
Accordingly, it is provided that the accused petitioners, named above, shall be released on bail of Rs.30,000/- each with one suitable surety of like amount each to the satisfaction of learned concerned court subject to the following conditions that the petitioners:
Page No.# 3/3 (a) shall co-operate the remaining investigation. (b) Shall not hamper or tamper with the evidence. (c) Shall not indulge in any activity pertaining to illegal liquor and shall co-operate with the process of law. 10. Violation of any of the conditions might entail cancellation of bail. 11.
