GP FOR CIVIL SUPPLIES The Court made the following ORDER: The present writ petition is filed under Article 226 of the Constitution of India seeking the following relief: “…to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the 4th respondent in issuing the proceedings RC.DT(LR)/186/2024 dated 23.07.2024 cancelling the Fair Price Shop Authorization of the petitioner in Shop No.1318030 of Salkapuram Village, Kallur Mandal, Kurnool District and not granting stay in the Revision pending before the 3rd respondent as illegal, improper, unjust arbitrary, colorable exercise of power, without enquiry and contrary to Andhra Pradesh State Targeted Public Distribution System Control Order, 2018 and also the well-established legal principles apart from being violative of the fundamental rights guaranteed to the petitioner under Articles 14, 19 and 21 of the Constitution of India and consequently set aside the same and pass such other orders as may be deem fit and proper in the circumstances of the case.” 2. Today when the matter is taken up learned counsel for the petitioner submits that, the petitioner has preferred an appeal before the 3rd respondent/Joint Collector and orders were passed in the said appeal. Hence, the cause in the writ petition does not survive for adjudication and the writ petition has become infructuous. 3. Recording the said submission, the Writ Petition is dismissed as infructuous. No order as to costs.
