Court No. - 42 Case :- CRIMINAL MISC. WRIT PETITION No. - 4106 of 2025 Petitioner :- Shaily Bajaj Tiwari @ Shailja Tiwari Respondent :- State of U.P. and Another Counsel for Petitioner :- Vijit Saxena Counsel for Respondent :- G.A. Hon'ble Mahesh Chandra Tripathi,J. Hon'ble Prashant Kumar,J. 1. Heard learned counsel for the petitioner and learned A.G.A. for the State- respondents. 2. This writ petition has been filed praying for the following reliefs: "A. Issue a writ order or direction in the nature of mandamus commanding the respondent no.2 to ensure that the petitioner shall not be taken into police custody either in the cases already registered against her or in a fresh case that may be registered against her in the District Lalitpur." 3. The instant writ petition has been preferred in anticipation that if the petitioner appears for the investigation of the case in which she has already been granted anticipatory bail, she may be arrested due to the addition of new sections during the investigation or in connection with another case. 4. Considering the facts and circumstances of the case and the petitioner’s involvement in multiple criminal proceedings, we are not inclined to exercise our discretionary jurisdiction. However, it is open to the petitioner to press the appropriate relief in the ongoing proceedings if any such proceedings are pending consideration. Furthermore, if the petitioner apprehends that new sections have been added during the investigation, she may seek anticipatory bail in that regard. Accordingly, the instant writ petition is wholly misconceived and stands rejected. (Prashant Kumar,J.) (Mahesh Chandra Tripathi,J.)
