1.D KRISHNA MURTHY Counsel for the Respondent(S):
1. The Court made the following:
THE HONOURABLE SRI JUSTICE T.C.D.SEKHAR WRIT PETITION NO. 18565 of 2025
ORDER: The present writ petition is filed questioning the
order dated 18.09.2024 passed by the 2"'^ respondent, whereunder the authorization of the petitioner’s fair price shop No.0742011 of Karumanchi Village, Savalyapuram Mandal, Painadu District was suspended pending enquiry. It is the case of the petitioner that she was appointed as fair price shop dealer of the said village and her authorization was extended from time to time and the same is in force. It is further case of the petitioner that based on report dated 17.08.2024 submitted by the Deputy Tahsildar, Vinukonda, the 2^^ respondent suspended the authorization of the petitioner, without issuing show cause notice and without conducting enquiry. Questioning the said order, the present writ petition is filed.

3.
Learned counsel for the petitioner would submit that the appointing authority shall dispose of the disciplinary case as early as possible preferably within period of three months from the date of filing clause 8(4) of Control Order, 2018. Despite completion of the period stipulated in the said clause, the 2'^^ respondent did not complete the enquiry as contemplated under the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018. as per i'
4. On the other hand, learned Assistant Government Pleader for Civil Supplies would submit that disciplinary proceedings could not be
4 completed in view of administrative contingencies. He would further submit that the enquiry will be completed as expeditiously as possible.
5. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Civil Supplies. Perused the material available on record.
6. As per Clause 8(4)(2) of the Andhra Pradesh State Targeted Public Distribution System (Control) Order, 2018, the appointing authority shall dispose of the disciplinary proceedings against the- fair price dealer as early as possible, preferably within a period of three (03) months from the date of filing. Admittedly, in the case on hand, the period stipulated under the said clause was completed in the month of December, 2024 itself. Therefore, by no stretch of imagination, the suspension order passed against the petitioner can't be continued beyond the said period. Further, the impugned order cannot be allowed to remain in force for a prolonged period. In view of the same, the impugned order is hereby set aside.
7. Accordingly, the Writ Petition is allowed. This
order will not preclude the authorities from proceeding against the petitioner in accordance with law. There shall be no order as to costs. As a sequel thereto, miscellaneous Petitions pending, if any, shall stand closed.
