PUBLIC PROSECUTOR % The Court made the following Order: The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) by the petitioners/Accused No.3, 6 and 7 for granting of pre-arrest bail in connection with Crime No.58 of 2025 of Bitragunta Police Station, SPSR Nellore District, registered for the alleged offences punishable under Sections 109(1), 351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). The case of the prosecution is that there is a government land in front of house of the defacto complainant and bushes and trees are grown up in the said land, due to which snakes are coming from the bushes. On 09.06.2025 at 8.30 a.m while clearing the bushes. Accused 1 and 8 came and stopped the JCB work claiming that the land as their own land and threatened to kill them. When the defacto complainant was present at her house along with her husband, all the accused came with deadly weapons and attacked. Accused No.3 hacked Surender with blunt knife on the face and Accused No.1 hit him with a rod and when Surender fell down, 2. Accused No.5 pick a stone and beat him on face. When the defacto complainant came to stop the accused, Accused No.7 hacked her with knife on the face and Accused No.6 beat one Venu with stone and caused injuries. 4.: Mr. K. Prudhvi Raj, the learned counsel for the petitioners contends that the petitioners are innocents of the alleged offence and have been falsely implicated by the police. It is further submitted that the petitioners are the sole earning members of their family and, they are ready to abide 3. any conditions that may be imposed by this Court, and it is urged to grant pre-arrest bail to the petitioners. Per contra, Mr.Neelotphal Ganji, the learned Assistant Public 4. Prosecutor vehemently opposed the grant of pre-arrest bail to the petitioner, submitting that the investigation is still underway and several material witnesses remain to be examined. It is contended that if the petitioner is released on pre-arrest bail, there is a strong likelihood that they may abscond, thereby hampering the ongoing investigation and evading the process of law. In view of the foregoing, it is urged that the petition be dismissed. Heard the learned counsel for the petitioners and the learned 5. Assistant Public Prosecutor. Perused the record. The Petitioners/ Accused 3, 6 and 7 were not yet arrested and they 6. moved this pre-arrest bail. There are specific allegations against the Petitioner/ Accused No.3 that he attacked one Surender, husband of the defacto complainant. The Petitioner No.2/Accused No.6 allegedly attacked with a stone on Venu. The Petitioner No.3/ Accused No.7 allegedly attacked LW-1 with a knife. Thus, there are specific overt acts attributed against the Petitioners. The injured by name Surender has not yet been examined by Police and his statement is not yet recorded. Wound Certificate is not yet issued by the Medical Officer concerned. Some more witnesses have been examined by the Investigating Officer. Altogether 5 persons have suffered injuries. LWs 4 to 9 are eye witnesses in this instant a land dispute pending between the Petitioners and defacto complainant and others. Merely because, Accused case. Of course, there is 1 to 5 were enlarged on regular bail by the jurisdictional Magistrate and Accused and 8 were granted pre-arrest bail by the learned Sessions Judge a ground for considering the request of the Petitioners for 2, 4 it is not enlarging the bail. In view of specific overt acts attributed against the petitioners, this Court is not inclined to grant pre-arrest bail to the Petitioners liable to be dismissed. and same is 7.
