[2025:RJ-JP:29433] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 11373/2025 Kishanlal S/o Late Shri Sohanlal Saini, Aged About 65 Years, Resident Of Lohdi Ka Bas, Naya Bas, Alwar, Rajasthan. ----Petitioner Versus 1. Noor Hussain S/o Rahmu, Aged About 70 Years, Resident Of Sonava Scheme No. 8, Alwar, Rajasthan. 2. Mukesh S/o Chhotelal, Resident Of Sonava Ki Dugri, Alwar, Rajasthan (Name Deleted In Compliance Of Order Dated 15.07.2024) ----Respondents For Petitioner(s) : Mr. Ravi Saini For Respondent(s) : HON'BLE MR. JUSTICE VINOD KUMAR BHARWANI Order 01/08/2025 The present writ petition has been filed by the petitioner under Article 227 of the Constitution of India seeking direction for expeditiously disposal of the Civil Misc. Appeal No.117/2024 pending before the learned Additional District & Sessions Judge No.4, Alwar. Learned counsel for the petitioner submits that the case pertains to the legal right of the petitioner over a mining lease originally granted by the Department of Mines to the father of the petitioner. It is further submitted that respondent No.1 is illegally interfering with the petitioner’s rights in the property in dispute. Counsel also submits that in the absence of any interim [2025:RJ-JP:29433] (2 of 2) [CW-11373/2025] protection, the petitioner is allegedly facing constant obstruction, threat to dispossession, and monetary losses. Therefore, a direction may be issued to the learned Appellate Court for expeditious disposal of the pending appeal, preferably on the next date of hearing i.e., 29.07.2025. Heard learned counsel for the petitioner and perused the material made available on record and the order-sheets of the learned Appellate Court. Perusal of record reveals that there is no undue or inordinate delay in the conduct of the proceedings pending before the learned Appellate Court. Accordingly, the writ petition is dismissed. Pending application(s), if any, also stand disposed of. (VINOD KUMAR BHARWANI),J SAURABH /23
