Heard Mr. SK SN Mohammad, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Addl. P.P. appearing for the State respondent.
2. This application under Section 483 of BNSS, 2023 has been filed by the accused/petitioner, namely, Jiaur Rahman, praying for grant of bail in connection with Azara P.S. Case No. 174/2025, under Sections 303(2)/317(2) of BNS, 2023. He was arrested on 22.11.2025.
3. As per the FIR dated 22.11.2025 lodged by S.I. Simanta Barman, Azara Police Station, a credible source information was received that stolen copper were stored in the scrap yard of Jiaur Rahman in that jurisdiction. That, GD No. 15 dated 21.11.2025 was made and thereafter, police team along with witnesses searched the scrap yard of the petitioner. During such search, 75 kgs of copper wire in cutted pieces from were recovered along with some other materials and that these articles were suspected to be stolen from the New Airport construction site. It is alleged that the petitioner as the owner of the scrap yard could not explain the presence of the large quantity of copper wire.
4. The learned counsel for the petitioner submits that the accused/petitioner is the owner of the scrap yard and various poor people come to deposit scrap and he denies that the recovered materials are sold.

6. The learned Addl. P.P. submits that the investigation has implicated the present accused petitioner and the investigation materials including statements of the witnesses have revealed about the said copper material being stolen as alleged.
7. In the given facts and circumstances and considering that investigation is still in progress, the bail of the petitioner stands rejected at this stage. Accordingly, this bail application stands disposed of.
