may be pleased topleased to issue an appropriate writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action on the part of the respondents particularly the respondents 2 to 4 in proposing to allot house site pattas in KONDA PORAMBOKE lands which arc having rich/rare mineral wealth covered by Sy.Nos. 1 and 11 of Paravada Village, Paravada Mandal, Visakhapatnam District under the scheme NAVARATNALU- PEDALANDARIKI ILLU contrary to G.O.Ms.No.74, Industries and Commerce (MI) Department, dated 16-02-2002, without even considering the objections raised by thepetitioners and others, as illegal, arbitrary, ultra virus, unjust against the procedure laid down in the Board standing orders and against the principles of natural justice and to consequently direct the respondents not to allot house site pattas in the above said KONDA PORAMBOKE lands in the interest of justice and to pass IA NO: 1 OF 2020 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to issue an interim direction against the respondents not to allot house site pattas under the scheme

The Court made the following Order:
Heard the learned counsel for the petitioners and the learned Assistant Government Pleader for the respondents. 2. This writ petition was filed questioning the action of the respondents particularly the respondent Nos.2 to 4 in proposing to allot house site pattas in ‘Konda Poramboke’ lands which are having rich/rare mineral wealth covered by Sy.Nos.1 and 11 of Paravada Village, Paravada Mandal, Visakhapatnam District under the scheme of Navaratnalu Pedalandariki Illu contrary to the G.O.Ms.No.74, Industries & Commerce (MI) Department, dated 16.02.2002 without even considering the objections raised by the petitioners and others. 3. On the other hand, the learned Assistant Government Pleader for the respondents submits that the respondent Nos.2 to 4 will follow the due procedure in respect of the subject land. 4. In view of the above said facts and circumstances, the respondent Nos.2 to 4 are directed to deal with the subject land in the said survey numbers of the said village strictly in accordance with law. The objections of the petitioners if any made afresh, shall be considered and disposed of by hearing all the parties concerned including the petitioners, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible. 4
