Also heard Mr. R.J. Baruah, learned Additional Public Prosecutor for the State. 2. This is an application under Section 482 of BNSS, 2023 has been filed by the petitioner, namely, Umesh Gogoi, seeking pre- arrest bail in connection with North Lakhimpur P.S. Case No. 265/2025 registered under Section 61(2)/316(2)/318(4)/340(2) of BNS, 2023. 3. The allegation against the present petitioner is that he being the Sarkari Gaonpradhan has issued a certificate showing some living persons as dead and with the help of that certificate, the other co-accused had transferred land that was pending in names of such people to others. 4. Pursuant to interim protection granted by this Court, the petitioner has appeared before the I.O and his statement has been recorded, wherefrom, it prima-facie appears that the act of the petitioner was not intentional. 5. Be that as it may, having regard to the facts and circumstances, custodial detention of the petitioner is not considered as necessary. Accordingly, the prayer for pre-arrest bail is allowed. 6. The order of interim bail dated 25.09.2025 is hereby made Page No.# 3/3 absolute subject to the conditions : (i) That the petitioner shall continue rendering the co-operation to the investigation ; (ii) That the petitioner shall not abscond; (iii) That the petitioner shall not hamper or tamper with evidence. 7.
