(At Present Confined District Jail, Dholpur). ----Petitioners Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Dushyant Jain For Respondent(s) : Mr. Manvendra Singh, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 26/08/2025 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The accused-petitioners have been arrested in connection with FIR No. 112/2025 registered at Police Station Raja Khera, District Dholpur for the offences under Sections 189(2), 115(2), 126(2) and 351(2) of BNS. 2. Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the injuries sustained to injured Shiva at his fingers were found to be grievous in nature, however, the injury sustained at his head was found to be simple in nature. The other injuries sustained to injured are neither dangerous to life nor at [2025:RJ-JP:33960] (2 of 3) [CRLMB-9470/2025] vital part, rather found to be simple blunt in nature or simple grievous in nature. There was no murderous intention at the part of the petitioners to cause fatal injuries to the injured. The accused-petitioners are in custody since 05.07.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that prior to the incident, the petitioner also assaulted the complainant and in span of short period, two incidents happened. The petitioners were also found to be involved in assaulting the injured in another FIR No.104/2025. The injuries sustained to injured are however, not dangerous to life but at the vital part, therefore, the bail application of the accused-petitioners may be dismissed. 4. Heard and perused the material available on record. 5. Considering the nature of injuries sustained to injured Shiva and the opinion of the concerned Doctor that the injury sustained at head of injured was not dangerous to life, rather found to be simple blunt in nature, considering the above facts, I deem it just and proper to enlarge the accused-petitioners on bail. 6. Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely: 1. Mandal Singh S/o Kaptan Singh and 2. Ramshankar S/o Kaptan Singh, in connection with FIR No. 112/2025 registered at Police Station Raja Khera, District Dholpur, shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before [2025:RJ-JP:33960] (3 of 3) [CRLMB-9470/2025] the court concerned on all the dates of hearing and as and when called upon to do so.
