Today when the petition is taken up for hearing, learned Assistant Public Prosecutor has produced a copy of instructions of the Inspector of Police, Itchapuram Town Police Station, Srikakulam District, wherein it is stated that pending the present petition, the Police, after due investigation on 22.09.2023, have filed a charge sheet vide C.C.No.269 of 2019 on the file of the Judicial First Class Magistrate Court, Itchapuram. 3. In view of the fact that a charge sheet vide C.C.No.269 of 2019 has already been filed on 22.09.2023, pending the present petition, learned counsel for the petitioner sought permission of this Court to withdraw the present petition. 4. Permission as sought for is accorded. Accordingly, this criminal petition is dismissed as withdrawn, with a liberty to challenge the aforementioned charge sheet, if at all the petitioner is aggrieved by the same.
