By this application under Section 482 of the BNSS, 2023 the petitioner has prayed for pre-arrest bail in connection with Basistha P.S Case No. 145/2025 under Section 61/303(2) of BNS, 2023 R/W Sections 24/41 of the Assam Forest Regulation Act. 3. The FIR dated 07.03.2025 reveals that on a secret information when the police personnel conducted a checking on the opposite side of the Jorabat Police Outpost at about 11:40 pm, they found a truck which they stopped and on search being made, they found timbers on the said truck and on being asked, the truck driver could not place any valid documents to the same and that it was suspected that the truck driver, in connivance of some evil elements, illegally fell trees and were secretly smuggling the same. 4. Ms. N.A Begum, learned counsel for the petitioner submits that the petitioner is the owner of the truck and that he had sold the truck long before the FIR was lodged. It is also noticed that the petitioner was released on interim bail vide order dated 31.07.2025 with the condition that he shall appear before the I/O within a period of 7(seven) days from the date of the order and in compliance of the said directions, it is noticed that the petitioner had appeared before the I/O and got his statements recorded. 5. Mr. K.K Parashar, learned Additional Public Prosecutor for the State of Assam, on further examination of the Case Diary had fairly stated that the I/O had noted in the Case Diary that no sufficient materials has been found against the petitioner. 6.
In view of the same, this Court deems it fit that the interim order
Page No.# 3/3 dated 31.07.2025 may be made absolute with the further direction that the petitioner may comply with the already mentioned directions in the said order. 7. Petition is disposed of. JUDGE Comparing Assistant
