Verma, Additional Advocates General, with Mr. Ravi Chauhan, Deputy Advocate General, for State. ____________________________________________________ Sandeep Sharma, Judge (oral): Petitioner herein, who at present is working as TGT Medical at Government High School Talla U/C GSSS Tundi, Tehsil Sihunta, District Chamba, Himachal Pradesh, has approached this Court in the instant proceedings, seeking therein direction to the respondents to consider and decide his pending representation dated 22.08.2025 (Annexure P-2), whereby he has prayed for his transfer from present place of posting to one of the stations, as detailed in the representation, on the ground of couple case. 2. It has been averred in the petition which is duly supported by the affidavit that petitioner shall be completing his normal tenure at present place of posting at present school in the month of December, 2025 and his wife is also working as Teacher in Education 1Whether the reporters of the local papers may be allowed to see the judgment? 2 Department and at present, she is posted at GSSS Baijnath, District Kangra, as such, petitioner may be transferred to a nearby station i.e. vacant stations – GHS Nanoan E/b Bhawarna District Kangra, GSSS Harsi and GSSS Hatwas, District Kangra. 3. Having regard to the nature of prayer and order proposed to be passed in the instant petition, this Court sees no necessity to call for the reply from the respondents, who are otherwise represented by Mr. Ravi Chauhan, learned Deputy Advocate General. Mr. Ravi, fairly states that petitioner has not completed his normal tenure of posting at present place and as such prayer made on her behalf for transfer cannot be accepted. 4. Having taken of the fact that petitioner is about to complete his normal tenure at present place of posting within a period of two months, coupled with the fact that Transfer Policy formulated by the Government of Himachal Pradesh, enables an employee to seek transfer/adjustment on the ground of couple case, this Court sees no impediment in issuing directions to the respondents to consider and decide the pending representation of the petitioner dated 22.08.2025 (Annexure P-2) expeditiously, preferably within four weeks from today. Ordered accordingly. Needless to say, authority concerned, while doing the needful in terms of instant order, shall afford an opportunity of being heard to the petitioner and pass 3 appropriate orders taking note of observations made herein above as well as Transfer Policy formulated by the Government of Himachal Pradesh.
