CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioners : Mr. Md. Zaid Ahmed, Advocate For the CBI

------
03/ 17.09.2025 Heard learned counsel for the petitioners and learned Spl.P.P. appearing for the Central Bureau of Investigation (CBI).
2.
The petitioners are apprehending their arrest in connection with R.C.-01(A)/2023(D), registered for the offences under Section 13(2) read with 13(1)(a) of the Prevention of Corruption Act, Section 120-B read with Sections 409 and 420 of the Indian Penal Code, pending in the court of learned Additional District Judge-I, Dhanbad.
3.
Learned counsel appearing for the petitioners submits that the allegation is made that the petitioners were involved with the Branch Manager in withdrawing and mis-utilizing the amount of the retired persons. He submits that allegations are made that in the account of the petitioner No. 1, Rs. 2.4 lakhs and in the account of petitioner No. 2, Rs. 37.60 lakhs have been transferred by the Branch Manager Manoj Kumar. He further submits that the other co-accused

persons have already been provided the privilege of anticipatory bail in A.B.A. Nos. 1979 of 2025, 4820 of 2025 and 4896 of 2025 respectively by this court.
4.
Learned Spl.P.P. appearing for the CBI has opposed the prayer and submits that the petitioners in connivance with the Branch Manager Manoj Kumar, have mis-utilized the amount of the retired persons, in view of that prayer for anticipatory bail may kindly be rejected.
5.
Considering that now the chargesheet has already been submitted and the petitioners were not arrested by the CBI in course of investigation, it appears that the petitioners have co-operated in the investigation and further the other co-accused have already been provided the privilege of anticipatory bail in the aforementioned A.B.As., I am inclined to provide privilege of anticipatory bail to the petitioners.
6.
Accordingly, the petitioners, named above, are hereby
directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Additional District Judge-I, Dhanbad, in connection with R.C.-01(A)/2023(D), subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
