ORAL ORDER
The petitioners (accused Nos.1 and 2), who have been charge sheeted for the offences punishable under Sections 376(2)(n), 384, 506 read with Section 34 of IPC, are before this Court seeking relief.
2. The prosecution alleges that the petitioners had sexual assault on the respondent No.2, and uploaded the picture of the complainant in social media.
3. The petitioners, who were present before this Court on 26.4.2025, and had filed a joint affidavit and a joint memo for compounding. Perusal of the same

indicated that the parties have amicably resolved the dispute among themselves. In terms of the settlement, the respondent No.2 has agreed to withdraw all the allegations against the petitioners citing that the FIR was lodged only to recover the jewelries from the accused No.1. The police during the course of investigation have recovered the jewelries. The joint affidavit and a joint memo are placed on record.
4. As per the settlement, the respondent No.2 has agreed to withdraw all allegations and has no objection to quashing the impugned proceedings to maintain cordial relationship and to prevent further hostility.
5. Although the offences alleged against the petitioners are cognizable and non-compoundable, considering that the parties have amicably resolved the dispute, subjecting the petitioners to trial would serve no purpose. In light of the settlement, the likelihood of the police filing charge sheet is remote and bleak.
6. In view of the above, continuing the criminal proceedings against the petitioners would amount to an abuse of the process of law.

7. Accordingly, the petition is allowed. The impugned criminal proceedings in S.C No.280/2024 pending on the file of the learned VI Additional District and Sessions Judge, Bangalore Rural District, Bangalore, is hereby quashed.
8. The respondent No.1 is hereby directed to release the jewelries seized with PF Nos.51 and 52 of 2024 dated 23.7.2024 in Crime No.108/2024 to the respondent No.2 forthwith.
