Heard Mr. P.K. Munir, learned counsel for the petitioner. Also heard Mr. R. J. Baruah, learned Addl. P.P. appearing for the State respondent. 2. This application under Section 483 of BNSS, 2023 has been filed by the accused/petitioner, namely, Baharul Islam, praying for grant of bail in connection with Pathsala P.S. Case No.94/2025 registered under Section 109(1)/118(2)/126(2)/131/3(5)/302 of the BNS, 2023. He was arrested on
06.11.2025. 3. The learned counsel for the petitioner submits that three accused persons were arrested on the same day and forwarded and out of them two were granted bail by this Court on 02.12.2025 in Bail Appln. 3698/2020. 4. The gist of allegation is that on 01.11.2025 at night the informant was beaten by a dog whereupon he went to the hospital along with his friend/neighbor, Dipankar Talukdar for taking vaccination and when they reached the hospital some persons upon seeing them shouted “kill him” he will attain heaven and thereafter, all of them attacked the informant and his friend without any provocation. It is alleged that one of the attackers hit the informant on his head with a rod and tried to attack him with a knife and another of them kicked him on his face and private parts. 5. “ 6. I have perused one medical document which indicates laceration and stitch. It is submitted that witnesses also implicated the petitioner. The accused persons are in custody since 06.11.2025 and investigation has progressed to some extent.”
6. The learned Addl. P.P. has objected to the grant of bail of the petitioner at this stage. 7. I find that present petitioner is also similarly placed as the other two persons, who have been granted bail.
Accordingly, in the given facts and circumstances, it is provided that the accused petitioner, named above, shall be released on bail of Rs.30,000/- with one suitable surety of like amount to the satisfaction of learned concerned court subject to the following conditions that the petitioner: (i) shall co-operate with the remaining investigation. (ii) shall not hamper or tamper with the evidence. (iii) shall not harass or harm the informant and other witnesses. (iv) shall not misuse the liberty to commit any illegal activity and he shall also not commit any act which is prejudicial to social and communal harmony. 8.
