This is an application filed under Section 483 of the BNSS, 2025, for grant of regular bail to the accused applicant in connection with Duliajan P.S. Case No.188/2025 registered under Section 105/61(2)(A) of BNS, 2025, read with Section 14/15 of the Assam Game and Betting Act, 1970. 3. The case arose out of an FIR dated 28.10.2025 lodged by Smt. Paro Chetry, the wife of the deceased. The gist of the allegation is that one Raghuveer Yadav along with Savitri Yadav and Monu Shah have been organizing gambling for a long time and encourage people to participate by calling them on their mobiles. That, on 19.10.2025, her husband was also invited for such gambling on the eve of Diwali but after going there, he was frightened that police may come and there upon while running away through a road, he fell down into a pit and his dead body was recovered on 26.10.2025. 4. Mr. Bora, learned Senior counsel for the petitioner submits that it is an unfortunate incident but the present petitioners are no where connected with the death of the informant husband. They were arrested on 01.11.2025 and they have also been examined and it is prayed that they may be granted at this stage. 5. The case diary has called for, has been received. 6. I have perused the bail objection submitted by the I/O. He has reiterated that the gambling was organized by Raghuveer Yadav and his wife Savitri Yadav along with accused person Monu Shah. It is also stated that later Nabadip Sonowal, Hasmat Ali and others also came for the gambling. 7. Upon perusing the case diary, I find that there has been progress in the Page No.# 3/3 investigation and the same is not completed. 8. Since the progress of investigation and length of detention - I am of the considered view that perhaps, the accused persons/petitioners herein can be granted bail. Accordingly, in the given facts and circumstances, the accused person herein is allowed to go on bail of Rs. 25,000/- each with one surety of like amount each to the satisfaction of the learned CJM, Dibrugarh and subject to the following conditions that:- (i) That the accused person shall co-operate with the remaining investigation. (ii) That the accused shall not hamper or tamper with evidence. (iii) He shall not misuse the liberty to commit any illegal activities, including any activities prohibited by the Assam Games and Batting Act, 1970. 9. In case of violation of any bail conditions, the prosecution shall be at liberty to move a suitable application for cancellation of the bail application of the petitioner. 10.
