….. Petitioner
Versus
1. The State of Jharkhand
2. Mr. Bishal Sagar, Deputy Commissioner-cum-District Magistrate-cum-District Explosive Magistrate, Deoghar
….. Opposite Parties
-----
CORAM
HON’BLE MR. JUSTICE RAJESH SHANKAR
----- For the Petitioner: None For O.P.No.2:
Ms. Omiya Anusha, A.C to A.A.G-IA
-----
14/24.01.2025 The present contempt application has been filed against the O.P.No.2 alleging wilful disobedience and non-compliance of the order dated 05.10.2023 passed by this Court in W.P.(C) No. 5625/2022.
Ms. Omiya Anusha, learned A.C to A.A.G-IA appearing on behalf of the O.P.No.2, refers to paragraph 8 of the supplementary show cause affidavit dated 09.01.2025 filed on behalf of the said opposite party, which reads as under:
‘’8. That it is humbly stated and submitted that in compliance of the order passed by the Hon’ble Writ Court, appropriate decision has been taken by the opposite party No.2 vide its reasoned order dated
26.11.2024.
A photo copy of the reasoned order dated 26.11.2024 is being annexed herewith and marked as Annexure-A to this supplementary show cause.’’
Considering that the O.P.No.2 has already passed a reasoned order dated 26.11.2024 in compliance of the aforesaid order of this Court, there is no need to further proceed with the matter.
The contempt proceeding as against the O.P.No.2 is dropped.
The present contempt application stands disposed of.
The petitioner is however at liberty to take appropriate recourse against the aforesaid reasoned order dated 26.11.2024 passed by the O.P.No.2.
