This is an application filed for rejection of the plaint or return of the plaint on the ground that after filing of a counterclaim in the proceedings under Section 104 of the Patents Act, 1970, the District Judge, Kamrup (Metro) did not have the jurisdiction to entertain the said proceedings. 3. Taking into account that in terms with Section 104 of the Patents Act, 1970, the matter has been laid before this Court, nothing further survives in the instant application. 4.
