ORDER; The present writ petition is filed questioning the orders passed by respondent No.2 in transferring the petitioner as Supervisor from AMC Guntur to AMC Kuchanapudi vide proceedings NO.AGC05-15021/24/2025-GNT-SUP-1, dated 09.06.2025 though the petitioner had filed W.P.No.14317 of 2025 questioning the same on the ground that the same was disposed of with a direction to consider the request of the petitioner in terms of the option given by the petitioner i.e., Duggirala or Gurajala.
2. The facts leading to the present writ petition are as follows: The petitioner was working as Supervisor from February 2019 onwards at Guntur Agriculture Market Committee. While so, the Government issued G.O.Ms.No.23 dated 15.05.2025 prescribing guidelines for transfer of employees. In pursuance thereof, the petitioner was called upon to exercise option. Accordingly, petitioner exercised options and opted for Duggirala
3 VN, J W.P.No.18301 of 2025 or Gurajala. Contrary to the above option given by the petitioner the petitioner was transferred to AMC Kuchanapudi. Questioning the same, the petitioner filed W.P.No.14317 of 2025 and the same was disposed of by this Court with a direction to the respondents to consider the request of the petitioner in terms of the aforesaid choices. By a speaking order dated 09.07.2025 the request of the petitioner was rejected. Hence, the present writ petition is filed.
Learned counsel for petitioner would submit that the
3. impugned order referred to the disciplinary case pending against the petitioner as the basis for his transfer to AMC Kuchanapudi and to a non-focal post.
Learned counsel would submit that there are 18 other similarly placed persons at AMC Guntur against whom charge memorandums were issued, but all of them were working in focal posts even on transfer.
Learned counsel contends that posting petitioner in a non-focal post is stigmatic and the petitioner is being singled out. Learned Government Pleader, on instructions, submits that
4. the petitioner was transferred to Kuchanapudi only on
4 VN, J W.P.No.18301 of 2025 administrative grounds as there was requirement of manpower in the said place. As regards posting in non-focal posting, the learned Government Pleader would submit that posting is discretion of employer and petitioner seeks for choice of post.
5. Heard the respective counsel.
6. Normally, the posting of an employee is an aspect which is best left to the wisdom of employer. However, in this case, similarly placed employees facing similar charges transferred to places of their option and are working in focal posts unlike the petitioner. As it is stated that there ( were are vacancies in the options exercised by the petitioner in the post of Supervisor i.e., Duggirala and Gurajala, this Court is inclined to pass the following
order: The respondents shall consider the representation dated 02.07.2025 of petitioner for posting in the options given by the petitioner i.e., Mangalagiri, Prattipadu, Chilakaluripeta, Duggirala and Gurajala subject to availability of vacancies and in a non- stigmatic post within a period of four (4) weeks from the date of receipt of copy of order.
5 VN, J W.P.No.18301 of 2025 i Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous applications pending, if any. shall stand closed.
